1) Who we are
This website and online store (the Site) are operated by Fitnesswise Holdings Pty Ltd (ABN 30 000 312 452) of 4/32 Campbell Ave, Dee Why, Sydney, 2099.
We are the authorised distributor of I-ANGEL products in Australia and sell I-ANGEL products via this Site. I-ANGEL is a brand owned by its respective owner; we act as the authorised distributor and retailer for Australia.
2) Acceptance of these Terms
By accessing or using the Site, placing an order, or creating an account, you agree to be bound by these Terms of Service (Terms) and our Privacy Policy and Returns Policy (together, the Policies). If you do not agree, please do not use the Site.
3) Australian Consumer Law (ACL)
Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law. If a product fails to meet a consumer guarantee, you are entitled to a repair, replacement or refund, and to compensation for reasonably foreseeable loss or damage.
4) Eligibility & Accounts
Keep your account credentials secure; you’re responsible for all activity on your account.
Provide current, complete and accurate information and promptly update it when it changes.
5) Product Information & Safety
Always read and follow the official I-ANGEL instructions, age/weight limits and warnings before use.
Babies and carriers must be monitored at all times; misuse can cause injury.
Contact a health professional before use if you or your child has a medical condition.
Product colours, dimensions and specifications may vary slightly from images due to manufacturing updates or screen settings.
6) Pricing, Taxes & Payments
Prices are shown in AUD and include GST unless stated otherwise.
We may change prices at any time before you place an order.
We accept the payment methods shown at checkout and use third-party processors; by paying, you authorise us (and them) to charge your chosen method for the order total, including shipping and taxes.
Promotions, discount codes and gift cards are subject to their stated terms and may not be combined unless explicitly allowed.
7) Orders, Acceptance & Cancellation
Your order is an offer to buy; we may accept or reject it at our discretion (e.g., due to stock limits, suspected fraud, pricing/description errors).
If we cancel after payment, we’ll refund you in full to your original payment method.
Pre-orders/backorders: estimated dates are guides only; if timing materially changes, we’ll update you and you may cancel for a refund before dispatch.
8) Shipping, Delivery & Risk
We ship to the locations offered at checkout and provide estimated delivery timeframes.
Risk in the goods passes to you on delivery to your nominated address (or collection point). Title passes when we receive full cleared payment.
Please check parcels on arrival and photograph any damage before opening where possible.
9) Returns, Exchanges & Faults
Our 30-Day Returns Policy (change-of-mind) and process apply in addition to your ACL rights. See: [link to your Returns Policy].
For faulty, damaged or incorrect items, contact us promptly with photos and your order number; we’ll organise a repair, replacement or refund in line with the ACL.
Purchases made via other retailers/marketplaces must follow the place of purchase returns process; we’ll still help with warranty support where appropriate.
10) Gift Cards & Store Credit
Non-transferable, not redeemable for cash (except as required by law).
Lost or stolen cards/credits will not be replaced. Expiry and balance rules are shown at issue.
11) Intellectual Property
All content on the Site (text, graphics, logos, images, video, code and design) is owned by us or our licensors and is protected by IP laws.
“I-ANGEL” and related marks are the property of their respective owners; used under licence/authorisation.
You may not copy, modify, distribute, mirror, scrape, or create derivative works from the Site without our prior written consent.
12) User Content (Reviews, Q&A, Photos)
By submitting content, you grant us a worldwide, royalty-free licence to use, reproduce, edit and display it for marketing and operational purposes.
Do not post unlawful, misleading, defamatory, harassing, obscene, infringing or commercial content, or anything that includes others’ personal data without consent.
We may moderate or remove content at our discretion.
13) Prohibited Conduct
You must not:
Interfere with or disrupt the Site, or try to bypass security or access controls.
Use automated tools to scrape, harvest data or overload our services.
Use the Site for any unlawful, misleading or fraudulent purpose.
14) Third-Party Services & Links
We are not responsible for third-party sites, apps, payment gateways or services linked from the Site. Your use of them is at your own risk and subject to their terms and privacy policies.
15) Warranties & Liability
To the maximum extent permitted by law, the Site is provided “as is” and we exclude all non-statutory warranties.
ACL carve-out: For non-major failures, our liability is limited (at our option) to replacement or resupply of the goods, or paying the cost of doing so. This section does not limit your rights for major failures.
We are not liable for indirect or consequential loss, loss of profits, data or goodwill, or in connection with delays or events beyond our reasonable control (e.g., courier delays, supply chain disruptions), except where not permitted by law.
16) Indemnity
You indemnify us (and our officers, employees and agents) from claims, losses and costs arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.
17) Changes to the Site and Terms
We may update the Site and these Terms from time to time. The version posted at the time you place an order will apply to that order. Material changes will be highlighted on the Site.
18) Suspension/Termination
We may suspend or terminate your access to the Site if you breach these Terms, engage in fraud or misuse the Site. You may also close your account at any time.
19) Governing Law & Disputes
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of NSW and the Commonwealth of Australia.
